1. Agreeing to these terms

By browsing marcyclothingny.com or placing an order through it, you agree to these terms.

This site is operated by Marcy Clothing, 4409 13th Ave, Brooklyn, NY 11219. Throughout these terms, "we", "us" and "our" mean Marcy Clothing, and "you" means the person using the site. If you do not agree to these terms, please do not use the site.

2. Who may order

You must be at least 18, or have the consent of a parent or guardian, to place an order.

You agree to give accurate and complete information when you order, including a shipping address you can receive a parcel at, and to keep that information up to date.

3. Products, descriptions and images

We describe each product as accurately as we can, but colours can look different on different screens.

Product pages state the colour, fit and fabric we hold on record for that style. Photographs are intended to show the garment; the other items worn in a photograph are styling and are not included. We do not warrant that a description, image or measurement is entirely error-free, and if an item is not what you expected, our Refund Policy applies.

4. Prices, availability and errors

All prices are in US dollars and may change without notice.

Stock is limited and a product shown on this site can sell out between your last visit and your order. If an item you have ordered is unavailable, or if a price or description was listed in error, we may cancel the order and will refund you in full. We are not obliged to fulfil an order placed at a price that was obviously wrong.

5. Orders and acceptance

Your order is an offer to buy, and it is accepted when we ship the item.

The confirmation email you receive at checkout acknowledges that we have your order; it is not acceptance of it. We may refuse or cancel an order — for example where we suspect fraud, where we cannot verify the billing details, or where stock has run out — and if we do, we refund any payment taken in full.

6. Payment

Payment is taken at checkout through our payment provider.

By submitting payment details you confirm you are authorised to use the payment method. We do not see or store your full card number. Orders are shipped only once payment has cleared.

7. Shipping and returns

Shipping charges, cutoffs and delivery estimates are set out in our Shipping Policy; returns and refunds are set out in our Refund Policy.

Both of those policies form part of these terms. In short: standard shipping is $8 and free over $70, express is $15, and you have 30 days from delivery to return an item with no restocking fee.

8. Acceptable use of this site

You may not use this site for any unlawful purpose, or attempt to interfere with how it works.

That includes scraping the site, introducing malicious code, attempting to gain unauthorised access to any part of it, or using it to harass anyone. We may withdraw access to the site from anyone who does.

9. Intellectual property

The text, layout and design of this site belong to Marcy Clothing or are used with permission.

You may view and print pages for your own personal use. You may not republish, sell or otherwise commercially exploit the content of this site without our written permission.

10. Limitation of liability

Our liability to you in connection with an order is limited to the amount you paid for it.

To the fullest extent the law allows, we are not liable for indirect or consequential losses, including lost profits or lost opportunity, arising from your use of this site. Nothing in these terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence.

11. Governing law

These terms are governed by the laws of the State of New York.

Any dispute arising from them is subject to the courts of the State of New York.

12. Changes to these terms

We may update these terms, and the current version is always the one posted on this page.

Continuing to use the site after a change means the updated terms apply to you.
